As the British royal house has filed a suit
against Closer, a French magazine that published topless pictures of Prince
William’s wife and Duchess of Cambridge, Catherine Middleton, an attorney has
argued that the photographer of the pictures could be jailed.
"If photographs of Kate Middleton have been
taken and published without her consent during her holidays, she may file a
complaint on the basis of article 9 of the French civil code and article 226-1
of the penal code," an online publication quoted French attorney Pierre
Hourcade.
Another source also says “St
James’s Palace has confirmed that legal proceedings for breach of privacy have
been commenced yesterday, Friday in France by the Duke and Duchess of Cambridge
against the publishers of Closer Magazine France”

Hourcade argued that French law dictates that
people have the right to respect for their private lives and, as a picture of a
person is considered an attribute of that person, photographic images fall
under that protection.
If convicted of violating a person's right to
privacy, punishment is up to a year in jail and a fine of 45,000 euros, or
almost $60,000.
The
photographs were allegedly taken a week ago by a swimming pool at a chateau in
Provence, France.
